Terms of use and contracting
Last updated: July 2026
1. Purpose
These terms govern access to the website https://tpvrest.com and the contracting of the TPV Cloud service marketed under the TPVRest brand, provided by Gonzalo Isidro Linares Amezcua (Digitacode), NIF 44268005C.
The service consists of a cloud software subscription for hospitality: after registration, email confirmation and payment, the professional TPVRest is activated, associated with the identifier chosen by the customer.
2. Economic conditions
- Price: 16 €/month per instance (VAT included), unless otherwise stated on the website at the time of sign-up.
- Free trial: 30 days from email confirmation, one per account and with no payment. When it ends, the POS is locked until you sign up; your data is retained.
- Automatic monthly renewal via Mollie. If a payment isn't completed, the service continues 7 days with a notice and is then locked until payment, without deleting your data.
- Amounts are shown excluding VAT unless otherwise stated. Applicable taxes will be applied.
- The subscription payment is processed securely online. The subscription renews monthly unless cancelled.
- Non-payment, chargeback or fraud may result in the suspension or cancellation of the service and of the instance.
3. Sign-up and access
- The customer registers with truthful data and chooses a unique identifier for their POS folder.
- You must confirm your email address.
- Once payment is confirmed, the company's professional TPVRest software is activated and access credentials are provided.
The customer is responsible for safeguarding their passwords, for the users they create within the POS and for any activity carried out from their instance.
4. Responsibility of the self-employed professional or contracting company
When signing up, the customer declares that they are self-employed, a professional or an authorised representative of a company, and accepts that:
- They are the sole party responsible for the use of the POS, for the data entered and for the operations of their business (sales, tickets, invoicing, inventory, staff, etc.).
- You must comply with the regulations applicable to your business (including, among others, tax, employment, consumer, data protection and, where applicable, electronic invoicing or equivalent systems).
- TPVRest is a technological support tool; it does not replace tax, accounting or legal advice, nor does it on its own guarantee the client's regulatory compliance.
- They are liable to third parties and to the Public Authorities for acts carried out through the system by them or by the persons they authorise.
- You must make additional backups of your business's critical information whenever you consider it necessary.
5. Limitation of the provider's liability
To the extent permitted by law, the provider shall not be liable for:
- Loss of business, lost profits, indirect damages or third-party claims arising from the customer's use of the POS.
- Errors, omissions or incorrect configurations made by the customer or its users.
- Interruptions beyond the provider's reasonable control (network, suppliers, force majeure).
- Any tax, accounting or penalty outcomes that may arise from the customer's activity.
The service is provided with reasonable availability (“as is”), with no specific uptime commitment unless agreed in writing. The provider's maximum liability, where applicable, shall be limited to the amount of the monthly fees actually paid by the customer in the three (3) months preceding the event.
6. Proper use and prohibitions
It is forbidden to use the service for unlawful purposes, to infringe third-party rights, to attempt to access other instances, to overload or attack the infrastructure, or to resell the service without authorisation. Breach may result in immediate suspension.
7. Cancellation
The customer may request cancellation by writing to info@tpvrest.com. Cancellation does not entitle the customer to a refund of periods already started, unless required by law or otherwise agreed. After cancellation, the provider may delete the instance and its data after a reasonable retention period.
8. Data protection
The processing of personal data is governed by the Privacy Policy. Regarding the data of end customers, employees or others that the contracting party enters into their POS, the contracting party acts as data controller and TPVRest as data processor to the extent that it processes that data in order to provide the service.
9. Governing law and jurisdiction
These terms are governed by Spanish law. For consumers, the legally mandatory courts shall apply. For businesses or professionals, the parties submit to the courts and tribunals of Granada, save for any mandatory provision to the contrary.
